Mashpee Town Hall Meeting Room 1 & 2
Commissioners Present: Jack Fitzsimmons (Chair), Ralph Shaw (Vice Chair), Len Pinaud, Jeff Cross, and Cass Costa

Jack Fitzsimmons called the meeting to order at 6:55 p.m.
Pre Hearing Items:
1. Request for Administrative Approval: SE 43-2472 12 Quinapen Ave. (Govoni)
The agent described the request for administrative approval from Cape and Islands Engineering to revise the septic plan. A Singulair Denite System is being added per request of the Mashpee Board of Health. Plans were also submitted showing the new system.
Motion made, seconded and unanimously carried to approve the administrative request.
2. Shields Property. (Meetinghouse Realty Trust)
The agent described the parcel (1.09 acres Map 45, Block 69) that is being offered for sale to the town for conservation purposes (asking price: $180,000). The agent informed the commission that Tom Fudala (Town Planner) is looking into possibly switching parcels for another plot of land that borders the Mashpee River within the existing Lopez Conservation Area off Meetinghouse Road. Mr. Fudala will request assistance from the Self Help program to cover part of the cost of the land purchase. The agent requested the Conservation Commission’s verbal approval for purchase of this parcel.
Motion made, seconded and unanimously carried to approve the purchase.
3. Lipnosky Family Trust
The agent informed the Commission as to the deeding of 9.53 acres of open space as part of a cluster subdivision located off Notre Dame Road in Mashpee (off Pimlico Pond Road) to the Mashpee Conservation Commission. The agent requested signatures from the Commission to approve the deeding of this parcel. Commissioners signed the deed for approval.
4. Americorps
The agent informed the commission of a recent project completed by Americorps volunteers in the Mashpee River Woodlands. Trail work, pruning and general clean up efforts were carried out by the Americorps volunteers and inspected by the agent.
Hearing Agenda:
7:00 p.m. Peter Moran, 76 Triton Way and 0 Beach Triton Way (NOI): (Re-construct existing revetment and coastal bank revegetation)
Tara Marden from Woods Hole Group represented the client and described the project. Tara described the construction methodology and access ways to the project. A pathway will be constructed along the existing revetment wall to access the lower portion of the revetment. A temporary rock road will be constructed at the bottom of the revetment wall. The access way will be dismantled, as the wall is reconstructed. Additionally, plantings will be made to fortify the eroding sections of coastal bank.
Jack Fitzsimmons requested that Tara address each one of the concerns brought up by Marine Fisheries in regards to this project. Tara addressed each of the concerns and reiterated that MFS concerns had been addressed in other filings along Triton Sound for similar projects. The agent concurred. No fueling of equipment will take place on or near the water. Temporary impacts to marine life existing at the toe of the wall may be encountered and they will be minimized using best available measures. Tara presented a letter from Natural Heritage and Endangered Species Program stating that the area of work is not located in the priority habitat map, hence Natural Heritage has no concerns over the project. The agent informed the commission that this work needs to get done because the current
revetment wall is eroding underneath and will eventually collapse. The agent recommended approval.

7:03 p.m. Charlotte Florence, 78 Triton Way (NOI): (Reconstruct the revetment wall and revegetation of coastal bank).
Tara Marden from the Woods Hole Group represented the client and described the project. She informed the commission that this project is directly tied into the Moran project for repair of existing revetment wall(s). The properties are next to each other and the revetment wall stretches across both properties. Tara described the construction methodology, and the agent recommended approval.
Motion made, seconded and unanimously carried to close and issue
7:06 p.m. David Lee, 31 Tide Run (RDA): (Placement of preconstructed gazebo and hot tub and addition of outdoor shower)
The agent informed the commission that this hearing was continued from the last meeting because Mr. Lee needed to seek approval from Board of Health in regards to his outdoor shower. At the previous meeting, Len Pinaud had asked whether or not the shower had to be hooked up to town septic. Mr. Lee had gained approval from Board of Health, and the agent presented a letter to the commission verifying this. Also, Lloyd Allen recommended some plantings be made to mitigate for the implementation of hot tub and gazebo. Mr. Lee’s plans showed plantings of inkberry and sweet pepperbush to be placed around the gazebo and hot tub. The agent recommended approval.
Motion made, seconded and unanimously carried for a negative determination.
7:09 p.m. Peter Merlino, 18 Quaker Run Road (NOI) (Construct and maintain a pier, ramp and float adding to existing pier).
The agent informed the commission that he had spoken with the applicant and recommended a continuance due to missing information on the plan of record as well as Harbormaster’s approval.
Motion made, seconded and unanimously carried to grant a continuance to 7/12/07 @ 7:09 p.m.
7:12 p.m. Karen Chertok, 114 Fells Pond Road (RDA) (After the Fact upgrade of existing dock).
Sumner Chertok represented himself and described the project to the commission. Mr. Chertok informed the commission that the dock was in a state of disrepair, and he was concerned about potential safety hazards for kids playing on his dock. He hired a contractor to rebuild the dock in the exact same footprint as the existing dock. The agent recommended approval.
Motion made, seconded and unanimously carried for a negative determination.
